For clear, concise, cost-effective advice on intellectual property, patents and industrial designs
My product is going to be made in China. Chinese patents are worthless, aren't they?
No. The patent system in China is relatively new, (since 1985). The Chinese are very well aware that their spectacular economic success has been largely dependent on providing a low cost manufacturing base to mainly foreign companies. They are also cognisant of the fact that those companies will not bring their know-how and intellectual property to China if they will lose it as a result. Accordingly, the Chinese government has repeatedly implemented changes to their patent laws and systems as well as other IP systems to make it more effective in deterring infringement. The Chinese system is not by any means perfect and enforcement may be difficult but not having intellectual property such as a patent will leave you with no rights to secure your investment. China is determined to become a world leading technical innovator and an effective patent system is regarded as essential to achieve this objective.
